could people just let me know if their staff work 38 weeks a year eg term time only how much holiday pay do they pay their staff ?

The law is 5.6 weeks per year. This is basic hours, does not include planning time or time for LJ's or staff meetings etc.. Pro rata of course for part time staff.

Is it not dependant on the hours you work . There was a tool on HMRC I think that calculated holiday hours

If they only work 38 weeks a year they don't get 5.6 weeks. They get 5.6 weeks divided by 52, times by the 38 weeks they work as they are only working 38/52. This gives 4.1 weeks entitlement. I do it by hours though so 20 hours a week for 38 weeks a year would be 20 x 5.6 = 112 hours. 112 hours / 52 times by 38 = 82 hours they are owed in holiday pay. Hope that makes some sense!

We state it in contracts how it's worked out and spread over the months this is not 'rolled up pay' I even checked with our legal consultants and this way is fine aslong as you prove to the employee how it's paid and that it's Ontop of hourly rate.

We pay bank staff every half term we look at past working hours and then discharge holiday entitlement as a payment on the next wage cycle this is defined in the wage slip as HP.

It's all blinking confusing x

Hi we are full daycare where staffs hours vary each week depending on ratios ,numbers etc.I am not sure

if i should work their hours in days or hours... but main question,...have new member of staff taken on mon and fri for 4 hrs only for an SEND child...she started 27th Feb 2015...our hol year runs from

1 Jan -Dec 31....can anyone tell me how many day/hours hols she is entitled to...as just paid her for both Easter bank holidays...but need to check fast before May day bank holiday...Thanks everyone..xx

sorry, not sure how you work it out if someone isn't doing regular hours each week, doesn't your payroll work it out ? if you google

'holiday pay calculator for casual or irregular hours workers' it might help :/
