tish501 Posted March 11, 2015 Share Posted March 11, 2015 Hi could anyone tell me the law regarding staff ,leaving for Maternity, asking for payment of bank holidays in advance,ie leaving May expecting payment for May ,Aug and christmas bank holidays. woodlands1997 Posted March 11, 2015 Share Posted March 11, 2015 You still have to pay them holiday pay even on maternity leave, so they still get however many hours holiday they are owed. tish501 Posted March 12, 2015 Author Share Posted March 12, 2015 Thanks, knew about the holiday pay etc it was just bank holidays that were the problem since they will occur within a normal SMP paid week...........or do I add this 3 or4 bank hols in the appropriate week,.? Mouseketeer Posted March 13, 2015 Share Posted March 13, 2015 Our 5.6 weeks pro rata does include all BHs that fall during our closed times, we only pay for the early May as it falls in an open week, and as said we still get our funding for that Monday, for instance I put a 11 wk term not a 10.4 on claim form for spring15, maybe other counties do deduct for BHs ?
