Ofsted and Nominated individual problems

Thanks so much for posting that Louby. That will be great to give out to prospective committee members. We have just been through the whole rigmarole with two new committee members. It has taken MONTHS and causes so much stress, waiting for the 'suitable person' confirmation to come through. The frustrating thing is that some people may only be on the committee for a few months after the long wait for the confirmation before we have to go through the whole convoluted process again. :angry: Grrr

Are you already a committee member and registered with ofsted as such? If yes, I believe that the current nominated person has to contact Ofsted, email is best, to inform that you will be taking over the role of nominated person and chair. If not, I believe that you will have to go the whole government gateway, dbs and ey2 route before becoming nominated person. 'The Committee' is the registered 'person'.

We are just starting this with new committee member / chair so we can swap notes on how it goes! Oh yes, if your setting is a registered charity, you have to make sure you update their records so that committee members lists match.

Hoping as time ha so passed you can give some advice on how you progressed with Ofsted

 

I have just become chair of a committee run preschool, company limited by guarantee and registered charity....

 

I have informed Ofsted that I am now the chair/nominated individual, completed my EY2 and I have received my government gateway token. What next? The previous chair said I may be requested to have an telephone interview??

once you log into your gateway account you can look up the list of who they have connected to your setting, I think the links is called 'self service' on same list as SEF.

I have just logged onto my Ofsted and the only people listed are myself (nominated person) and the setting manager.

Should the rest of our committee also be listed as they all form the registered person, I am the nominated individual...wow it's so confusing

 

I plan to eventually call Ofsted and update them with all the committee details after our meeting next week.

Hi C1403, it certainly is confusing, I just presumed they all appeared once they'd completed the EY2, I didn't add anyone but they were all on the list, I could remove leavers last year, but not this year, even though it states 'any changes you make will take immediate affect'

Thanks...I'll get there eventually. When you look online are all your EY2 completed members listed? There are others that completed their EY2 and registered long before me and are not listed on the self service part of Ofsted. So assuming they are just listing the manager and nominated individual....I shall make a call next week

hi, yes they all appear, I had a call from ofsted today to say I'm not on the charity registration as a trustee, so can't be nominated person, I'm on it as the main contact and we've only ever added officers to trustees it's not been a problem for years, now it is :-/

All our trustees are listed on the charity commission and all but two have had their suitability letter from Ofsted so technically should be on Ofsted records, yet their web service just shows myself and the manager.

Argh this is driving me up the wall. Myself and the outgoing chair had everything worked out and then you realise there is a can of worms to be opened !

I had to join the committee, so another Dbs, complete ey2 and health form to be the Nominated person (I am also the manager). That is what Ofsted told me to do.

Hi, I know this thread is a little old now but I have a similar query and am seeking some advice!

Our existing NI and Manager of the setting is leaving and I am taking on the role. I am not on the Committee (and neither is the outgoing NI/Manager). I completed an EY2 and this has been returned by Ofsted and they have stated that a manager cannot be NI. However, the Chair of our Committee changes every couple of years and so it makes more sense for the Manager to take on the NI role. 

My thought was to complete new DBS with updates, be co-opted onto the Committee and then complete the EY2 again - my concern is that I will do all this and then Ofsted will still say no. Or I could ask the Chair to be the NI, accepting that we will have to change the NI again in a couple of years. 

Any guidance would be appreciated.

Whatttttttt, many of us are managers and NI for committee runs settings, I’d phone again and hope someone different picks up your call.....you’ll get a different answer :ph34r:

Have a strange feeling NI is the 'company' and np can be the manager?????? or maybe i'm just going crazy!!

This did come up recently - I'll dig about and see if I can find the infomation, Helen andI met with Ofsted to discuss this exact point.

The specific section is below:

Qu: Why was a change made that prevented a setting manager being the ‘nominated person’ for Ofsted purposes? This doesn’t make sense given that they know more about the setting that anyone else involved.
Answer: It was explained that this was to bring early years in line with schools. The Ofsted team explained that the registered provider should be viewed in the same way as a school governing body. They are ultimately responsible for the curriculum, the staff and everything that goes on in the provision including the appointment and discipline of staff. The nominated person is the representative to Ofsted of the registered provider. The manager cannot be the nominated person if they are not part of the registered provider because they cannot be responsible for the curriculum and for appointing and disciplining themselves (as a person that works for the registered provider). We found this easier to understand once we had viewed the registered provider as being equal to the governing body of a school. It made sense to view the nominated person as the ‘chair of governors’ and the setting manager as the school head teacher. Ofsted were clear that the manager can talk to Ofsted (as can the head teacher) but cannot hold overall responsibility if they are not part of the registered provider (the committee/ governing body)

Thank you for this Rebecca. I am hoping that I can interpret their answer to mean that if I'm on the committee (governing body) then I can be the NI :)

You’re right Fm, I didn’t read it correctly and thought it was about being nominated person....but then 2 of my committee recently did ey2 and ticked they would be nominated individuals and caused mayhem, I was demoted from nominated person and when I tried to phone to sort it out they wouldn’t speak to me (even though I’ve been it since the beginning of time..almost), this led to HMRC issuing a new user name and password to one of them for the tax voucher regustration (thankfully no parent details were on it) we had to get Ofsted and HMRC to speak to each other in the end to undo the mess it caused.
