OFSTED, EY2s, Committees and DBS? Where to start?

I have been through this very thing with my committee recently and we still aren't out of the woods with ofsted.

 

We are a company limited by guarantee and an unincorporated charity (i think) anyway, I joined the committee in October with a view to becoming the nominated person.

 

So, I have started the nominated person process -

 

Problem 1 - because I am becoming nominated person and I work as Manager within ratio, I have to complete a health declaration?? Because previous chair wasn't in ratio or worked - she didn't need top do a health declaration???

 

Problem 2 - In our memorandums of articles, we have to have a quorate of five members, so five people are chosen to be directors and are listed on companies house. The other members are committee members and are not listed on companies house.

 

So, we thought this all fine, Ofsted came and said no - you can't run like that, whoever is involved in decision making and seeing/hearing information about children must be known to Ofsted. So then our process begins of asking all committee members to renew their DBS, and then the update service followed by the EY2 - to then be informed each time by Ofsted that the EY2 cannot be submitted for a committee member as they are not listed on Companies House??

 

So, spoke to Ofsted on Friday who informed me that because we are a limited company, all of our members who hear/see information about attending children must be known to Ofsted and the only way of doing this is by everyone becoming Directors????

 

He also told me that as of January 2016, all Nominated persons must be a member of the committee or in our case a Director?? When I queried how they expect volunteers to take this role on, his answer was that it is intended to be done with support from the Manager.

 

So, don't know where we are or what we do..... my committee aren't happy about me becoming a Director as I guess there is a wooly line between Director and employee.

 

I have tried as Manager to take more on as our committee members are too busy and now I don't know what to do.

 

Any help would be great

All my committee people are listed as directors on companies house, it's never put any one off joining as we are LTD by guarantee they are only liable for a £1 if it goes belly up unless there is wrong doing I can see if this isn't the case at w buisness you would b put right off....

 

I fell short of this once as EY2 got returned as not on CH, I must admit my chair doesn't do much at all and is fully supported by me in what needs to b done and shouldn't be done. I make him very aware of his actions and what he needs to know, it's pritty much like school governors as chair of governors has support from head teacher but yer head is answerable to governors and ultimately the chair. As a governor I am made fully aware of my legal responsibilites yet I am led a great deal as I don't know how to run a school but my job is to hold to account the head and challenge the school. I must admit being a governor has helped me greatly in leading my committee at work and I've pinched loads of ideas to make my committee who I don't ask much of at all know there roles and responsibilities and also streamline my data that I give them to make it easier for them to challenge me :)

Gosh this really is a minefield isn't it????! I can feel the headache lurking already.

 

Ok so just to confirm if I have read everyone's replies properly:

 

1. Contact OFSTED and find out who they have recorded as our committee members?

 

2. Check this matches our records and records listed on charity commission website?

 

3. If they aren't listed with OFSTED I need to get individuals to complete EY2 and register for Update service, complete DBS?

 

4. EY3 completed for anyone no longer on committee?

 

5. I am registered as manager but not on committee. I have completed my EY2 many years ago and have DBS check done every 3 years - Am I safe? lol

 

I wish they would communicate this so much better than they have done. We literally do not hear a thing from OFSTED. It's worrying that such vital changes that can affect the status of our PVI settings is so poorly communicated!!!!

So after never receiving the email from OFSTED regarding the registration update excel sheet, we suddenly receive a chasing up email to complete it within 5 days.

 

I am fully expecting a notification to say the info that they have on file is different from what we have submitted now :( So more work for me to complete.

 

I have requested on the form that I can now have dealings with OFSTED so I can actually so some of the work myself!

 

I have been assured that all committee members have completed the EY2 and have an up to date DBS check-watch this space!

I have a problem with the EY3 form as it contains a lot of personal details but you just send it back via an unsecure email address. I phoned Ofsted who don't want a hard paper copy so said just pdf it and send but it's still not secure!

 

To send children's details we use a secure link....why should we be expected to send our details via an open email?

 

Anyone else feel like this?

I have had a reply!!! We have passed information gathering stages yay lol.

We will now receive a new certificate through the post.

 

Ey3 on occassions we have not had to hand all details so you could try omitting some data, or could you password protect the document and send it then tell them to contact you for password.

 

We have sent them via post before suppose you could chance it X

I didn't realise that you couldn't send them in the post, we have still been doing that. Why on earth can't the actually write to settings and inform them of changes, they don't tell you anything and then penalise you if you don't do what they didn't tell you - gggggrrrrrrr.

 

Our supervisor has resigned and is leaving next month and we don't have a replacement yet, I'm a bit worried about informing Ofsted that she has left and not being able to inform them of a replacement yet :-/

Be very clear in how you word the changes. I wrote chairperson .........name..... To remain. And they took her off. I didn't find out for 4 months so she needs to complete Ey2 again (not dbs as registered with the update service).

 

I can't believe it's not an online form that you submit to avoid errors.

Just going through the process of getting two new people on to the committee. Ofsted does helpfully have a set of instructions on how to do this, but less helpfully only some of the people on the help line know this. We had a very nice lady send us this - can't find a link to it but could maybe copy it to anyone wanting it.

The process as stated by previous posts is to get a DBS first and so long as it is an enhanced disclosure for the children's workforce and the person it is for signs up to the update service you can get it done through any of the DBS services - it does not have to be done through Capita.

Fredbear - where did you find the EY3 - The Ofsted website is so confusing and useless I can't find (or maybe it is me who is confused and useless!)
