Our Chairperson stood down earlier in this school year and our Secretary stepped up to become Chair, we had already had her DBS checked when she joined at the previous AGM so thought all would be OK. We sent an EY3 form and covering letter explaining the swap of roles. Ofsted wrote to the previous chairperson acknowledging her not being the chair/nominated person anymore, but wouldn't accept the replacement as the nominated person as she hadn't completed an EY2. She had completed a her DBS check via the online link Ofsted provided and received her DBS Enhanced Certificate (we thought all was hunky dory). I emailed them to explain this and they replied asking me to answer security questions, which I did and didn't hear anything further, I didn't think much about it again. Then this week, we received a letter from Ofsted (dated 16th December) titled "Failure to meet welfare requirements" advising that they haven't had an EY2 and/or DBS check for the new nominated person and that if we didn't reply within 14 days they would commence action to cancel our registration, and may prosecute and fine us £5,000. I nearly had a heart attack and felt physically sick when I read it, especially since their letter was dated two days before we broke up for Christmas and we had only just seen it! The new chair has phoned and been told that something went wrong with the update service part of her check and that has invalidated her DBS check which will have to be done again! Why on earth couldn't anyone tell us that something had gone wrong with the update service at the time?! And although they were able to tell her that, they wouldn't discuss the threatened action with her (as she's not the nominated person in their eyes) so we are now in a position where Ofsted won't speak to anyone at our setting about the issue as none of us are the nominated person, they won't even speak to the ex Chair who tried to help. The whole thing seems very unfair and ludicrous to me and we can't even find out if they have started the process of taking action against us and we thought we had done everything correctly. Anyway, this rant was really about letting everyone know what kind of bother you can inadvertently get yourself into and it might be worth checking that your committee did managed to correctly register to the update service! They informed me that as a manager they would still continue to speak to myself, even though I can no longer be named as the nominated person. Has your manager tried to speak to them at all. I think the whole system is a minefield, completely and utterly time consuming and not user friendly at all. Only this week three of our new committee have just received their enhanced disclosures. But no reference was made with the certificate regarding the update service or any link to complete this compulsory part, and within the determined timescale. Mouseketeer Posted January 15, 2016 Share Posted January 15, 2016 (edited) All committee members must complete an ey2, but what a stupid situation they will have to speak to someone, I'm fully expecting to be told I can't be the nominated person (having been it since the beginning of ofsted) though I guess I could just go on the committee and presume the ey2 I did when staff also had to do them would still count....but who knows anymore ? And the really daft thing is they've sent us the form to complete as the nominated person so that the form can tell us we can't be the nominated person ....had we known where it was leading we could have said 'sorry we haven't got anyone who is eligible to complete the form' :-/ Edited January 15, 2016 by Mouseketeer Link to comment Share on other sites More sharing options...

zigzag Posted January 15, 2016 Share Posted January 15, 2016 This whole system needs a complete overhaul, it is so ridiculous. I had some very frustrating conversations with Ofsted back in September and on one occasion ended up tearful from the pure frustration of it all. The whole process through DBS, update and EY2 seems so long. barcombeplaygroup Posted January 15, 2016 Share Posted January 15, 2016 I am the Supervisor of our setting and also the nominated person. I am not a committee member - we had or Ofsted inspection in February 2015 and the inspector was quite happy with this. lsp Posted January 15, 2016 Share Posted January 15, 2016 I am in the same situation barcombeplaygroup. The problem is under the new rules the 'nominated oerson' must be a member of the committee. There can be another two people who can registered to able to speak to ofsted so one of these can be the manager. I have decided that although our constitution allows staff members to be on the committee (another thing to check!) I am not prepared to do this. 'Unfortunately the form you have provided is incomplete; therefore we are unable to accept it. As from the 1st January 2016, the Nominated Individual must be part of the organisation’s governing body. For example, if the organisation is a company then the Nominated Individual is required to be one of the directors, likewise if it was a committee the Nominated Individual is required to be a committee member. As you are not part of the organisation's governing body you are unable to hold the role of Nominated Individual. That means dbs with update service, then EY2 and finally EY3???? Oh, and your constitution must allow staff members to be on the committee.
