EY2 OR NOT!

I have one committee member who hasnt completed an EY2 even after I've said, I've had to lay it on the line with the chair that she gets one or we get requires improvement as Ofsted have phoned every 2 weeks for past two months as the person is registered on companies house and they know this and therefore they want to know why she isn't on there system!!! I'm spending my holidays getting ready for an inspection as I've never seen Ofsted be so much on someone's tail!!! It's imperative they get this done, beg them to do one...... On the EY2 it states someone making up an organisation this shows you they need checking. Phone Ofsted and get them to ohone your registered person they then may listen. Good luck :)

Well, that's just it, my nominated person has spoken to Ofsted on the phone and apparently Ofsted told him the committee do not need to fill out EY2 forms or get DBS checks. I can only assume the nominated person has given them the wrong info. He waffled something about the charity that runs us, maybe they need DBS checks, but not the committee that runs the preschool. But they are mostly the same people on both committees. With just a parent on the preschool one and not the other one. But the other committee oversees the charity as a whole. But either way, neither committee has the relevant checks. I'm banging my head against a wall. His last email began with "Let me make this crystal clear" and then told me why he wasn't proceedung with ey2. Basically said Ofsted phoned him and said they didn't need them. I'm bored of being spoken down to now.

Okay, if you type in Ofsted and committee rules in your browser, scroll down and find my Nottingham early years, Nottingham City council site, there is a page there you can show him.

Trying to find the best document for you to show them is so hideously difficult.

Sorry it actually says useful information for early years and childcare register.

At our recent inspection, Mrs o was concerned I hadn't kept them up to date with names and said, with a rather exasperated tone, 'what names have you got regardless of DBS EY2?' We then checked to see if we had names that matched. We had mostly a match, the report said 'should' communicate better with ofsted. Not a word about getting DBS or EY2s done!

I contacted them yesterday to ask about a recently checked CM becoming staff....no they didn't need a new check carried out just a health declaration booklet completed at the cost of £100 !!! Told her to forget that and remove her as CM and we'd start again with dbs, didn't matter that any of the other staff are mad just not the CM, then asked if one of the existing staff wanted to be a committee member would they need the health check...uh no :/ was then asked if we could go through my existing CMs as she didn't think I could possibly have a committee that big, even though I phone them every year following Agm to remove old they had people still going back 4 years !

Right. This is the document my nominated person is quoting from and what Ofsted quoted from, it's the framework for inspection. The relevant but ive copied and pasted here. The rest you can read if you follow the link. This does seem to say they only check the nominated person:

 

"24. For applicants whose prime purpose is not childcare but who wish to provide childcare on non-domestic premises, for example a nursery, we only check the individual the organisation nominates to represent them; we call this individual the nominated person. For all other applications on non-domestic premises we check everyone who is part of the registered person."

If you go to page 17 it tells you who does and doesn't need a check. My nominated person insists we're a statutory body. We are a charity that runs clubs for people with disabilities. The preschool is one aspect which has a committee. But the registered person is the charity. He argues we fall under the statutory body section so therefore only the nominated person needs the necessary checks. Thoughts?

My chair and myself had an interview with Mrs O to make him the registered person for the setting in January. We were told that every member of our committee needed to get a DBS check then they had to do the EY2. We then had to display a list with all staff and Committee DBS numbers, date they were obtained, who obtained them and the name of the company we got them through. We were told if this was not display when we next had an inspection we would be inadequate as it is a statuary requirement.

I thought they'd stopped doing these interviews? Unless are you a brand new setting?

 

I agree with everyone else about the whole committee needing DBS checks, my inspector 4 weeks ago checked the evidence of this.

I also told her that Ofsted are still sending correspondence to someone who left the group (&country) 4 years ago and I keep telling them but they don't remove her and her response was "yes, I'm not surprised!"

 

Quote 69 - is it because you've said that you are also part of a bigger group of people who are doing more than just Childcare? Although how that excludes you I really don't know!

Okay my thoughts are:

Is the statutory body governed by a school.

If yes then it would mean your committee would be checked under the school governance.

If no then I find the whole thing very strange, because in essence it says only one person needs to be checked and surely that can't be right.

Pease let us know your conclusion on this one.

Well I've emailed the chair today and said as it seems so confusing surely it's better to inform Ofsted of the committee members and get them DBS checked, then we're covered. I've pointed out that all the staff are working hard and I'd hate us to get pulled up on a technicality, even if the inspector is wrong and they don't need them. For the sake of a few DBS checks?!

 

No we are not governed by a school. We are overseen by a charity that provides activities for people with special needs. But we do have a committee that runs us. On our registration document is the charity name that oversees us. But our last Ofsted report clearly states that we are committee owned and run. So I think just better to get all committee members checked. Problem is our nominated person is threatening to walk out if he's made to do this. I say let him.

So why isn't he already checked as the 'nominated' person ? If he doesn't think anything means him you'd be better off without him, I'm not sure where committees are concerned it makes sense for anyone but the managers/leaders to be the nominated person.

How ridiculous to threaten to do this, when you are only trying to protect all concerned.

If your committee are volunteers then it won't cost the earth and give you peace of mind.

As for displaying someone's DBS certificate number, well it's certainly not something we do or are going to. They are in each personal staff file or in our committee file.

Good luck with this as it sounds very tricky for you.:)

We are a Preschool , Committee run with Charity status. We were inspected in January 2015 this year after waiting for 6 years.

We were given INADEQUATE , we were all mortified. We have worked so hard to keep the preschool running. We were giving GOOD for Learning and Developement and our parents couldn't have praised us enough and have been very supportive since.

The Inspector was very NICE ( never thought I'd say that about an inspector) she said our parents would be very shocked. Our Commtee had not all completed there checks or tied them in with the Preschool with a EY2 form the list she had was different to my list of Committee members she even went off and phoned to check there was not any updates recorded at OFSTED, she said there was nothing she could do as it was a Statutory requirement to notify OFSTED of any changes and they still had our old Chair as the Nominated person.

We removed inadequate because our paperwork wasn't in order. Our Chair has workd hard to make sure everything is now in order ready for there return, We will have to have a full inspection within six months. We're been visited by an Early Years Advisor and she's happy that everything is now in order.

Well I've sent my final plea to the committee to get the checks done. I've said I might be wrong and they don't need them, but I'd rather be wrong knowing we did all we can to check all people associated with making decisions on children's behalf than right and then have to face an inadequate rating. I've said for the sake of a few pounds let me be wrong, but let's check all members just in case I'm not.

We'll see what happens.
